These Terms and Conditions ("Terms") govern your use of services provided by A&C Moving and Storage ("Company," "we," "our," or "us"). By engaging our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By requesting a quote, booking services, or entering into a service agreement with A&C Moving and Storage, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Agreement Formation
- A binding agreement is formed when you accept our written estimate
- Verbal agreements must be confirmed in writing
- Changes to the agreement require written consent from both parties
- These Terms supersede any previous agreements or understandings
2. Services Description
A&C Moving and Storage provides the following services:
Moving Services
- Residential moving (local and long-distance)
- Commercial and office relocations
- Packing and unpacking services
- Furniture disassembly and reassembly
- Loading and unloading assistance
Storage Services
- Short-term and long-term storage solutions
- Climate-controlled storage units
- Inventory management and tracking
- Pickup and delivery to storage facilities
Additional Services
- Specialty item handling (pianos, artwork, antiques)
- Moving supplies and materials
- Cleaning services (upon request)
- Temporary storage during moves
3. Estimates & Pricing
Estimate Types
- Non-binding Estimates: Approximate costs based on information provided
- Binding Estimates: Fixed prices for specified services (requires in-home survey)
- Hourly Rates: Time-based pricing for local moves
Pricing Factors
Final costs may vary based on:
- Actual weight and volume of items
- Distance and accessibility of locations
- Additional services requested
- Time of year and day of week
- Special handling requirements
Price Changes
We reserve the right to adjust pricing for:
- Services not included in the original estimate
- Changes to inventory or service requirements
- Unexpected obstacles or delays beyond our control
- Additional stops or waiting time
4. Liability & Insurance
Basic Coverage
All moves include basic liability coverage at no additional charge:
- Coverage limited to $0.60 per pound per article
- Covers loss or damage during transportation
- Does not cover normal wear and tear
Full Value Protection
Enhanced coverage available for additional fee:
- Full replacement or repair value coverage
- Comprehensive protection for valuable items
- Deductible may apply
Limitations of Liability
The Company's liability is limited and excludes:
- Items of extraordinary value (unless declared)
- Damage due to normal wear and tear
- Pre-existing damage or defects
- Acts of God, weather, or natural disasters
- Delays in delivery beyond our reasonable control
- Consequential or indirect damages
5. Payment Terms
Payment Schedule
- Local moves: Payment due upon completion
- Long-distance moves: Deposit required, balance due on delivery
- Storage services: Monthly billing or prepayment options
Accepted Payment Methods
- Cash, certified check, or money order
- Credit cards (Visa, MasterCard, American Express)
- Electronic fund transfer (for commercial clients)
Late Payment
- Late fees may apply to overdue accounts
- Services may be suspended for non-payment
- Collection costs may be charged to customer
6. Cancellation Policy
Customer Cancellation
- More than 48 hours: No cancellation fee
- 24-48 hours: 50% of estimated cost
- Less than 24 hours: 100% of estimated cost
- Same day: Full charges apply
Company Cancellation
We may cancel services due to:
- Unsafe working conditions
- Failure to provide accurate information
- Non-payment or credit issues
- Violation of terms and conditions
- Circumstances beyond our control
Rescheduling
- Requests with 48+ hours notice: No fee
- Short-notice changes may incur fees
- Subject to availability and scheduling
7. Customer Responsibilities
Preparation Requirements
- Provide accurate inventory and service requirements
- Ensure access to both pickup and delivery locations
- Obtain necessary permits or parking permissions
- Disconnect and prepare appliances for moving
- Back up electronic data before transport
Packing Responsibilities
- Pack personal and fragile items securely (if self-packing)
- Use appropriate packing materials
- Label boxes clearly with contents and destination
- Separate items not to be moved
Disclosure Requirements
Customers must disclose:
- Valuable or fragile items requiring special care
- Hazardous or prohibited materials
- Access restrictions or special requirements
- Insurance claims history for valuable items
8. Prohibited Items
For safety and legal reasons, we cannot transport:
Hazardous Materials
- Flammable liquids, gases, or solids
- Explosives, ammunition, or fireworks
- Toxic or poisonous substances
- Radioactive materials
- Compressed gas cylinders
Perishable Items
- Food items (frozen, refrigerated, or opened)
- Plants and live animals
- Medications requiring refrigeration
Personal Items
- Important documents (carry personally)
- Cash, coins, or valuable papers
- Jewelry and precious stones
- Personal medical records
9. Dispute Resolution
Claims Process
- Claims must be reported within 24 hours of delivery
- Written notice required within 9 days
- Supporting documentation must be provided
- Investigation period may take up to 30 days
Mediation and Arbitration
If disputes cannot be resolved directly:
- Mediation through neutral third party preferred
- Arbitration may be required for larger claims
- Legal proceedings subject to Ontario jurisdiction
Limitation of Actions
- Legal action must be commenced within two years
- Claims for loss or damage limited to declared value
- Attorney fees not recoverable except where provided by law
10. Force Majeure
We are not liable for delays or non-performance due to circumstances beyond our reasonable control, including:
- Natural disasters and severe weather
- Government actions or regulations
- Labor strikes or transportation delays
- Equipment failures or accidents
- Pandemics or health emergencies
11. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any legal proceedings must be brought in the appropriate courts of Ontario.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.
